Code Ann. § 36-9-314","heading":"Perfection by control.","body":"(a) A security interest in investment property, deposit accounts, letter-of-credit rights, electronic chattel paper, or electronic documents may be perfected by control of the collateral under Section 36-7-106, 36-9-104, 36-9-105, 36-9-106, or 36-9-107.\n(b) A security interest in deposit accounts, electronic chattel paper, letter-of-credit rights, or electronic documents is perfected by control under Section 36-7-106, 36-9-104, 36-9-105, or 36-9-107 when the secured party obtains control and remains perfected by control only while the secured party retains control.\n(c) A security interest in investment property is perfected by control under Section 36-9-106 from the time the secured party obtains control and remains perfected by control until:\n(1) the secured party does not have control; and\n(2) one of the following occurs:\n(A) if the collateral is a certificated security, the debtor has or acquires possession of the security certificate;\n(B) if the collateral is an uncertificated security, the issuer has registered or registers the debtor as the registered owner; or\n(C) if the collateral is a security entitlement, the debtor is or becomes the entitlement holder.","path":["Title 36 - COMMERCIAL CODE","CHAPTER 9 Commercial Code—Secured Transactions","Part 3 Perfection and Priority"],"source_url":"https://www.scstatehouse.gov/code/t36c009.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:08:49Z","sha256":"00e3fd3726982e4821ac0fac7b198768371caa49c5e8be8df02c87f9820b2be4","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-36-9-313","next":"us-sc/s.c.-code-ann.-36-9-315"},"notice":"GroundRules: Original legal text.
