Code Ann. § 36-9-609","heading":"Secured party's right to take possession after default.","body":"(a) After default, a secured party:\n(1) may take possession of the collateral; and\n(2) without removal, may render equipment unusable and dispose of collateral on a debtor's premises under Section 36-9-610.\n(b) A secured party may proceed under subsection (a):\n(1) pursuant to judicial process; or\n(2) without judicial process, if it proceeds without breach of the peace.\n(c) If so agreed, and in any event after default, a secured party may require the debtor to assemble the collateral and make it available to the secured party at a place to be designated by the secured party which is reasonably convenient to both parties.","path":["Title 36 - COMMERCIAL CODE","CHAPTER 9 Commercial Code—Secured Transactions","Part 6 Default"],"source_url":"https://www.scstatehouse.gov/code/t36c009.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:08:49Z","sha256":"812d8978e1084573f43d6eae54cf6cb194c6dca21cb1a3f3dfdf8fbfb773a8c9","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-36-9-608","next":"us-sc/s.c.-code-ann.-36-9-610"},"notice":"GroundRules: Original legal text.
