Code Ann. § 38-71-260","heading":"Duties of health insurer of child to custodial parent.","body":"If a child has health coverage through the health insurer including a group health plan, as defined in Section 607(1) of the Employee Retirement Income Security Act of 1974 or health maintenance organization as defined in Section 38-33-20, of a noncustodial parent, the insurer shall:\n(1) provide information to the custodial parent as may be necessary for the child to obtain benefits through that coverage;\n(2) permit the custodial parent or the health care provider, with the custodial parent's approval, to submit claims for covered services without the approval of the noncustodial parent; and\n(3) make payments on claims submitted in accordance with item (2) directly to the custodial parent, the provider, or the state Medicaid agency.","path":["Title 38 - INSURANCE","CHAPTER 71 Accident and Health Insurance","ARTICLE 1 General Provisions"],"source_url":"https://www.scstatehouse.gov/code/t38c071.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:14:39Z","sha256":"c0f73000366f3b7db05103254d4eeaf62440fd862ce988894cafe07c652a44e2","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-38-71-255","next":"us-sc/s.c.-code-ann.-38-71-265"},"notice":"GroundRules: Original legal text.
