Code Ann. § 39-8-110","heading":"Chapter's effect on conflicting tort, restitutionary, and other laws; effect on remedies.","body":"(A) Except as provided in subsections (B) and (C), this chapter displaces conflicting tort, restitutionary, and other law of this State providing civil remedies for misappropriation of a trade secret.\n(B) This chapter does not affect:\n(1) contractual remedies, whether or not based upon misappropriation of a trade secret or protection of a trade secret;\n(2) the provisions of the South Carolina Tort Claims Act.\n(C) Any and all other civil remedies that are not based upon misappropriation of a trade secret or upon protection against misappropriation of a trade secret are governed by the rules of procedure, rules of evidence, regulations, and the common law applicable to the administrative law tribunal or court where the action is filed.","path":["Title 39 - TRADE AND COMMERCE","CHAPTER 8 Trade Secrets"],"source_url":"https://www.scstatehouse.gov/code/t39c008.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:16:49Z","sha256":"12dda7cb062f3f1182bd3a0c0f0276f461d3b8b44d7373f6fe02c400b81fbbef","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-39-8-100","next":"us-sc/s.c.-code-ann.-39-8-120"},"notice":"GroundRules: Original legal text.
