Code Ann. § 39-9-206","heading":"Administrative hearing before assessment of a civil penalty; amount of penalty.","body":"(A) Subject to appropriate judicial review, upon a violation of this chapter, the Commissioner of Agriculture or his designee may conduct an administrative hearing and, upon notice and an opportunity to be heard, may assess a civil penalty of not less than:\n(1) one hundred nor more than two hundred dollars for a first offense;\n(2) two hundred fifty nor more than five hundred dollars for a second offense within two years from the date of the first offense;\n(3) one thousand nor more than five thousand dollars for a third offense within two years from the date of the first offense.\n(B) A civil penalty collected under this chapter must be transmitted to the State Treasurer for deposit in a fund to be used by the Department of Agriculture.","path":["Title 39 - TRADE AND COMMERCE","CHAPTER 9 Weights and Measures"],"source_url":"https://www.scstatehouse.gov/code/t39c009.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:16:54Z","sha256":"0619799c522d340402d6331e73772ad17418d09ba11474d97f70c263bf90e894","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-39-9-203","next":"us-sc/s.c.-code-ann.-39-9-208"},"notice":"GroundRules: Original legal text.
