Code Ann. § 40-10-130","heading":"Basis for refusal to issue license.","body":"(A) As provided in Section 40-1-130, the department may refuse to issue a license or certification to an applicant who has:\n(1) had a fire sprinkler license or certification denied, suspended, revoked, or otherwise disciplined;\n(2) engaged in work as a fire sprinkler contractor without a valid license as required under this chapter;\n(3) submitted a bid without a valid license when one is required by law;\n(4) committed an act that would be grounds for disciplinary action under this chapter;\n(5) submitted false or misleading information;\n(6) aided or abetted a person in the violation of a provision of this chapter or regulations promulgated under this chapter;\n(7) been convicted of a crime involving unlawful breaking or entering, burglary, or larceny; or has a history of addiction to a narcotic drug; \"conviction\" means the entry of a plea of guilty or nolo contendere or a verdict rendered in open court by a judge or jury;\n(8) any outstanding monetary judgments related to being a fire sprinkler contractor; or\n(9) engaged in conduct that demonstrates bad faith, dishonesty, untrustworthiness, or incompetence as a fire sprinkler contractor.\n(B) A license or certificate or registration may not be issued to an applicant:\n(1) for a minimum of one year after the date of revocation of a similar license or certificate issued by this State or any other state or jurisdiction;\n(2) who is presently under suspension by a professional licensing entity in this or any other state or jurisdiction; or\n(3) who has unresolved complaints or charges pending against him before this or any other professional licensing board in this or any other state.","path":["Title 40 - PROFESSIONS AND OCCUPATIONS","CHAPTER 10 Fire Protection Sprinkler Systems Act"],"source_url":"https://www.scstatehouse.gov/code/t40c010.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:20:34Z","sha256":"1125d1fae1ea3e13f2332b8caa55037b492cff7b74ca548a1406124ccb984623","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-40-10-120","next":"us-sc/s.c.-code-ann.-40-10-140"},"notice":"GroundRules: Original legal text.
