Code Ann. § 40-53-180","heading":"Grounds for refusal to issue, suspension, or revocation of license.","body":"The Division may refuse to issue or may suspend or revoke a license on any one or more of the following grounds:\n(a) Failing to inform a subject to be examined as to the nature of the examination;\n(b) Failing to inform a subject to be examined that his participation in the examination is voluntary;\n(c) Material misstatement in the application for original license or in the application for any renewal license under this chapter;\n(d) Wilful disregard or violation of this chapter or of any regulation or rule issued pursuant thereto, including, but not limited to, wilfully making a false report concerning an examination for polygraph examination purposes;\n(e) If the holder of any license has been adjudged guilty of the commission of a felony or misdemeanor involving moral turpitude;\n(f) Making any wilful misrepresentation or false promises or causing to be printed any false or misleading advertisement for the purpose of directly or indirectly obtaining business or trainees;\n(g) Having demonstrated unworthiness or incompetency to act as a polygraph examiner as defined by this chapter;\n(h) Allowing one's license under this chapter to be used by any unlicensed person in violation of the provisions of this chapter;\n(i) Wilfully aiding or abetting another in the violation of this chapter or any regulation or rule issued pursuant thereto;\n(j) Where the license holder has been adjudged as a habitual drunkard or mentally incompetent as provided for in the 1976 Code;\n(k) Failing, within a reasonable time, to provide information requested by the Division as the result of a formal complaint to the Division which would indicate a violation of this chapter; or\n(l) Failing to inform the subject of the results of the examination if so requested.","path":["Title 40 - PROFESSIONS AND OCCUPATIONS","CHAPTER 53 Polygraph Examiners Act"],"source_url":"https://www.scstatehouse.gov/code/t40c053.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:23:09Z","sha256":"a96569b10832a279389b423fa81457c269f52ab5a45ad1a75e791a6b9f789fd8","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-40-53-170","next":"us-sc/s.c.-code-ann.-40-53-190"},"notice":"GroundRules: Original legal text.
