Code Ann. § 56-1-2120","heading":"Driving with measurable amount of alcohol prohibited; possession of alcoholic beverage.","body":"(A) A person may not drive a commercial motor vehicle within this State while having a measurable amount of alcohol in his body.\n(B) A person who drives a commercial motor vehicle within this State while having a measurable amount of alcohol in his system or who refuses to submit to an alcohol test under Section 56-1-2130 must be placed out-of-service for twenty-four hours.\n(C) A person who drives a commercial motor vehicle in this State with an alcohol concentration of four one-hundredths of one percent or more must be disqualified from driving a commercial motor vehicle under Section 56-1-2110.\n(D) A person must not be on duty or operate a commercial motor vehicle while he possesses an alcoholic beverage that is not part of the manifest and transported as part of the shipment.","path":["Title 56 - MOTOR VEHICLES","CHAPTER 1 Driver's License","ARTICLE 13 South Carolina Commercial Driver License Act"],"source_url":"https://www.scstatehouse.gov/code/t56c001.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T07:52:19Z","sha256":"04a21e63a08c2e4e6510a4364e7e880d7cdc23dc63e8bbd68ed9201ee8703adf","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-56-1-2115","next":"us-sc/s.c.-code-ann.-56-1-2130"},"notice":"GroundRules: Original legal text.
