Code Ann. § 59-150-400","heading":"Conspiracy defined; penalty.","body":"(A) A person commits an offense of conspiracy if he with intent that an offense pursuant to this chapter be committed:\n(1) agrees with one or more other persons that they or one or more of them engage in conduct constituting the offense; and\n(2) one or more of the persons so agreeing performs an overt act in pursuance of the agreement.\n(B) An agreement constituting a conspiracy may be inferred from acts of the parties.\n(C) It is not a defense to prosecution for conspiracy pursuant to this section that:\n(1) one or more of the co-conspirators is not criminally responsible for the offense;\n(2) one or more of the co-conspirators has been acquitted, if at least two co-conspirators have not been acquitted;\n(3) one or more of the co-conspirators has not been prosecuted or convicted, has been convicted of a different offense, or is immune from prosecution;\n(4) the actor belongs to a class of persons, who by definition of the offense, are legally incapable of committing the offense in an individual capacity; or\n(5) the offense was not actually committed.\n(D) A person who commits an offense pursuant to this section is guilty of a felony and, upon conviction, must be fined not more than twenty-five thousand dollars or imprisoned for not more than five years, or both.","path":["Title 59 - EDUCATION","CHAPTER 150 South Carolina Education Lottery Act"],"source_url":"https://www.scstatehouse.gov/code/t59c150.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:06:04Z","sha256":"54994b3cbbb357c8ff10f73da776c0372b6861e4da3370628064b891ee5b1439","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-59-150-390","next":"us-sc/s.c.-code-ann.-59-150-410"},"notice":"GroundRules: Original legal text.
