Code Ann. § 62-7-1001","heading":"Remedies for breach of trust.","body":"(a) A violation by a trustee of a duty the trustee owes to a beneficiary is a breach of trust.\n(b) To remedy a breach of trust that has occurred or may occur, the court may:\n(1) compel the trustee to perform the trustee's duties;\n(2) enjoin the trustee from committing a breach of trust;\n(3) compel the trustee to redress a breach of trust by paying money, restoring property, or other means;\n(4) order a trustee to account;\n(5) appoint a special fiduciary to take possession of the trust property and administer the trust;\n(6) suspend the trustee;\n(7) remove the trustee as provided in Section 62-7-706;\n(8) reduce or deny compensation to the trustee;\n(9) subject to Section 62-7-1012, void an act of the trustee, impose a lien or a constructive trust on trust property, or trace trust property wrongfully disposed of and recover the property or its proceeds; or\n(10) order any other appropriate relief.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 7 South Carolina Trust Code","Part 10 Liability of Trustees and Rights of Persons Dealing With Trustee"],"source_url":"https://www.scstatehouse.gov/code/t62c007.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:54Z","sha256":"ccb5a7fd306413da9e59b78e0a43b67eaec747c975c753ffdff199f1ce2c595f","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-7-933","next":"us-sc/s.c.-code-ann.-62-7-1002"},"notice":"GroundRules: Original legal text.
