Code Ann. § 62-7-1012","heading":"Protection of person dealing with trustee.","body":"(a) A person other than a beneficiary who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers is protected from liability as if the trustee properly exercised the power.\n(b) A person other than a beneficiary who in good faith deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of their exercise.\n(c) A person who in good faith delivers assets to a trustee need not ensure their proper application.\n(d) A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(e) Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 7 South Carolina Trust Code","Part 10 Liability of Trustees and Rights of Persons Dealing With Trustee"],"source_url":"https://www.scstatehouse.gov/code/t62c007.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:54Z","sha256":"4bab72a8d9fc2be63bc135e48fbb8073d7791162d18536cb7a93e02035705c0f","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-7-1011","next":"us-sc/s.c.-code-ann.-62-7-1013"},"notice":"GroundRules: Original legal text.
