Code Ann. § 62-7-503","heading":"Exceptions to spendthrift provision.","body":"(a) In this section, \"child\" includes any person for whom an order or judgment for child support has been entered in this or another State.\n(b) Even if a trust contains a spendthrift provision, a beneficiary's child who has a judgment or court order against the beneficiary for support or maintenance may obtain from a court an order attaching present or future distributions to or for the benefit of the beneficiary.\n(c) The exception in subsection (b) is unenforceable against a special needs trust, supplemental needs trust, or similar trust established for a disabled person if the applicability of such a provision could invalidate such a trust's exemption from consideration as a countable resource for Medicaid or Supplemental Security Income (SSI) purposes or if the applicability of such a provision has the effect or potential effect of rendering such disabled person ineligible for any program of public benefit, including, but not limited to, Medicaid and SSI.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 7 South Carolina Trust Code","Part 5 Creditors' Claims; Spendthrift and Discretionary Trusts"],"source_url":"https://www.scstatehouse.gov/code/t62c007.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:54Z","sha256":"acc53911b50cf6756b18134cd3c71e6b2854c1a704ea0539d22841e8599aad38","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-7-502","next":"us-sc/s.c.-code-ann.-62-7-504"},"notice":"GroundRules: Original legal text.
