Code Ann. § 62-7-807","heading":"Delegation by trustee.","body":"(a) A trustee may delegate duties and powers that a prudent trustee of comparable skills could properly delegate under the circumstances. The trustee shall exercise reasonable care, skill, and caution in:\n(1) selecting an agent;\n(2) establishing the scope and terms of the delegation, consistent with the purposes and terms of the trust; and\n(3) periodically reviewing the agent's actions in order to monitor the agent's performance and compliance with the terms of the delegation.\n(b) In performing a delegated function, an agent owes a duty to the trust to exercise reasonable care to comply with the terms of the delegation.\n(c) A trustee who complies with subsection (a) is not liable to the beneficiaries or to the trust for an action of the agent to whom the function was delegated.\n(d) By accepting a delegation of powers or duties from the trustee of a trust that is subject to the law of this State, an agent submits to the jurisdiction of the courts of this State.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 7 South Carolina Trust Code","Part 8 Duties and Powers of Trustee"],"source_url":"https://www.scstatehouse.gov/code/t62c007.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:54Z","sha256":"310927d8769b133ba4f3abd20e6b11f621db420d25a9556effa3c09a3f4706a0","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-7-806","next":"us-sc/s.c.-code-ann.-62-7-808"},"notice":"GroundRules: Original legal text.
