Code Ann. § 62-7-913","heading":"Allocations to principal.","body":"A trustee shall allocate to principal:\n(1) to the extent not allocated to income pursuant to this part, assets received from a transferor during his lifetime, a decedent's estate, a trust with a terminating income interest, or a payer under a contract naming the trust or its trustee as beneficiary;\n(2) money or other property received from the sale, exchange, liquidation, or change in form of a principal asset, including realized profit;\n(3) amounts recovered from third parties to reimburse the trust because of disbursements described in Section 62-7-926(A)(7) or for other reasons to the extent not based on the loss of income;\n(4) proceeds of property taken by eminent domain, but a separate award made for the loss of income with respect to an accounting period during which a current income beneficiary had a mandatory income interest is income;\n(5) net income received in an accounting period during which there is no beneficiary to whom a trustee may or must distribute income; and\n(6) other receipts as provided in Sections 62-7-917 through 62-7-924.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 7 South Carolina Trust Code","Part 9 South Carolina Uniform Principal and Income Act"],"source_url":"https://www.scstatehouse.gov/code/t62c007.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:54Z","sha256":"20bdba23d99f9dcb950e57b7fd49a802a8e4262e0d44bd598a6eab501f525642","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-7-912","next":"us-sc/s.c.-code-ann.-62-7-914"},"notice":"GroundRules: Original legal text.
