Code Ann. § 62-8-116","heading":"Judicial relief.","body":"(a) The following persons may petition a court to construe a power of attorney or review the agent's conduct, and grant appropriate relief:\n(1) the principal or the agent;\n(2) a guardian, conservator, or other fiduciary acting for the principal;\n(3) a person authorized to make health care decisions for the principal;\n(4) the principal's spouse, parent, or adult descendant;\n(5) an individual who would qualify as a presumptive heir of the principal;\n(6) a person named as a beneficiary to receive any property, benefit, or contractual right on the principal's death or as a beneficiary of a trust created by or for the principal that has a financial interest in the principal's estate;\n(7) a governmental agency having regulatory authority to protect the welfare of the principal;\n(8) the principal's caregiver or another person that demonstrates sufficient interest in the principal's welfare; and\n(9) a person asked to accept the power of attorney.\n(b) Upon motion by the principal, the court shall dismiss a petition filed pursuant to this section if the court determines that dismissal is in the best interest of the principal.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 8 South Carolina Uniform Power of Attorney Act","Part 1 General Provisions"],"source_url":"https://www.scstatehouse.gov/code/t62c008.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:59Z","sha256":"9934266d9b1e8d1c2756b6504e3af2226c596e6016bbd8304e09c3fa2bf0863d","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-8-115","next":"us-sc/s.c.-code-ann.-62-8-117"},"notice":"GroundRules: Original legal text.
