Code Ann. § 62-8-403","heading":"Effect on existing powers of attorney.","body":"Except as otherwise provided in this article on the effective date of this act:\n(a) this article applies to a power of attorney created on or after the effective date of this act;\n(b) the procedural provisions of this article apply to a judicial proceeding concerning a power of attorney commenced on or after the effective date of this act;\n(c) the applicable law in effect before the effective date of this act applies to a power of attorney created or restated before the effective date of this act;\n(d) the procedural provisions of this article apply to a judicial proceeding concerning a power of attorney commenced before the effective date of this act unless the court finds that application of a procedural provision of this act would substantially interfere with the effective conduct of the judicial proceeding or prejudice the rights of a party, in which case that procedural provision does not apply and the applicable procedural provision in effect at the commencement of the judicial proceeding applies; and\n(e) an act done before the effective date of this act is not affected by this act.","path":["Title 62 - SOUTH CAROLINA PROBATE CODE","ARTICLE 8 South Carolina Uniform Power of Attorney Act","Part 4 Miscellaneous Provisions"],"source_url":"https://www.scstatehouse.gov/code/t62c008.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:08:59Z","sha256":"d36771a817c22437ec9a11ce3d9561ca4ac09a4c9f5261af2c501fd1a525ec87","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-62-8-402","next":"us-sc/s.c.-code-ann.-63-1-10"},"notice":"GroundRules: Original legal text.
