Code Ann. § 63-17-3040","heading":"Concurrent filings for support.","body":"(A) A tribunal of this State may exercise jurisdiction to establish a support order if the petition or comparable pleading is filed after a pleading is filed in another state or a foreign country only if:\n(1) the petition or comparable pleading in this State is filed before the expiration of the time allowed in the other state or the foreign country for filing a responsive pleading challenging the exercise of jurisdiction by the other state or the foreign country;\n(2) the contesting party timely challenges the exercise of jurisdiction in the other state or the foreign country; and\n(3) if relevant, this State is the home state of the child.\n(B) A tribunal of this State may not exercise jurisdiction to establish a support order if the petition or comparable pleading is filed before a petition or comparable pleading is filed in another state or a foreign country if:\n(1) the petition or comparable pleading in the other state or foreign country is filed before the expiration of the time allowed in this State for filing a responsive pleading challenging the exercise of jurisdiction by this State;\n(2) the contesting party timely challenges the exercise of jurisdiction in this State; and\n(3) if relevant, the other state or foreign country is the home state of the child.","path":["Title 63 - SOUTH CAROLINA CHILDREN'S CODE","CHAPTER 17 Paternity and Child Support","ARTICLE 23 Uniform Interstate Family Support Act"],"source_url":"https://www.scstatehouse.gov/code/t63c017.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T08:09:49Z","sha256":"a4334150f75770c354e94c2c92c8d4dd4a833c0d2519fa7073b08b54d1e8845e","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-63-17-3030","next":"us-sc/s.c.-code-ann.-63-17-3050"},"notice":"GroundRules: Original legal text.
