{"data":{"id":"us-sd/sdcl-46a-3b-9","jurisdiction":"us-sd","citation":"SDCL § 46A-3B-9","heading":"Commencement of directors' terms--Vacancies--Director filling unexpired term.","body":"Each director shall take office on January first of the year following the election, or not later than sixty days after a special election.\nAn office becomes vacant:\n(1) Upon the occurrence of any event listed in § 3-4-1; or\n(2) Upon the expiration of a term of office, if no qualifying petitions have been filed or if no successor has qualified for the office, unless otherwise provided in chapters 46A-3A to 46A-3E, inclusive.\nIf an office becomes vacant, the remaining directors must fill the position by appointing a qualified candidate from the director area for which a vacancy exists.
