{"data":{"id":"us-sd/sdcl-60-15-3","jurisdiction":"us-sd","citation":"SDCL § 60-15-3","heading":"Promulgation of rules.","body":"The secretary of the department shall promulgate rules, in accordance with chapter 1-26, relating to the administration of this chapter in the following areas:\n(1) Program and performance standards for registering apprenticeship programs, as provided for in 29 C.F.R. §§ 29.1 to 29.14, inclusive (January 1, 2026);\n(2) Standards for an apprenticeship program eligible for registration, as provided for in 29 C.F.R. § 29.5 (January 1, 2026);\n(3) Contents of an apprenticeship agreement, as provided for in 29 C.F.R. § 29.7 (January 1, 2026);\n(4) Procedures and requirements for the registration of a program and an apprentice, as provided for in 29 C.F.R. § 29.5 (January 1, 2026);\n(5) Procedures and methods for monitoring compliance of apprenticeship programs, as provided for in 29 C.F.R. §§ 29.1 to 29.14, inclusive (January 1, 2026);\n(6) The provision of technical assistance to a program, as provided for in 29 C.F.R. § 29.13 (January 1, 2026);\n(7) Complaint procedures, as provided for in 29 C.F.R. § 29.12 (January 1, 2026);\n(8) Procedures and requirements for the cancellation, deregistration, or reinstatement of a registered apprenticeship program, as provided for in 29 C.F.R. §§ 29.8 and 29.9, (January 1, 2026);\n(9) Procedures and requirements for the temporary suspension, cancellation, or deregistration of an apprenticeship agreement, as provided for in 29 C.F.R. § 29.7 (January 1, 2026); and\n(10) The process for according reciprocal approval for federal purposes to an apprentice, apprenticeship program, and standards that are registered in other states by the United States Department of Labor, or a registration agency, if reciprocity is requested by a sponsor, as provided for in 29 C.F.R. § 29.13 (January 1, 2026).\nCommission Note: This section becomes effective, per SL 2026, ch 204, § 4, \"upon the date the United States Department of Labor Office of Apprenticeship formally recognizes the state apprenticeship agency established by this [chapter].
