Code Ann. § 35-15-1012","heading":"Protection of person dealing with trustee","body":"(a) A person other than a beneficiary who in \"good faith\", as defined in § 47-1-201 , assists a trustee, or who in \"good faith\" and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee's powers is protected from liability as if the trustee properly exercised the power.\n(b) A person other than a beneficiary who in \"good faith\" deals with a trustee is not required to inquire into the extent of the trustee's powers or the propriety of their exercise.\n(c) A person who in \"good faith\" delivers assets to a trustee need not ensure their proper application.\n(d) A person other than a beneficiary who in \"good faith\" assists a former trustee, or who in \"good faith\" and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(e) Comparable protective provisions of other laws, see §§ 47-8-101 - 47-8-407, relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["TN Code","Title 35","Chapter 15"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_tn_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:26Z","sha256":"9318aaa9e581d39e832293f31523868eb272a9d33f23bed6eacc560ca9c44844","source_id":"us-tn","stale":false,"prev":"us-tn/tenn.-code-ann.-35-15-1011","next":"us-tn/tenn.-code-ann.-35-15-1013"},"notice":"GroundRules: Original legal text.
