Code Ann. § 65-17-104","heading":"Permit required","body":"No person shall undertake the construction, operation, or redevelopment of a wind energy facility or a wind energy facility expansion in this state unless a certificate of public convenience and necessity is first obtained from the public utility commission pursuant to chapter 4, part 2 of this title, and a permit is obtained from the local legislative body of the local government in which the facility or expansion will be located pursuant to §§ 65-17-105 - 65-17-113.
