Code Ann. § 66-29-174","heading":"Civil penalty for evasion or failure to perform duty - Civil penalty for making fraudulent report","body":"(a) If a holder enters into a contract or other arrangement for the purpose of evading an obligation under this part, or otherwise willfully fails to perform a duty imposed on the holder under this part, the treasurer may assess against the holder a civil penalty of one thousand dollars ($1,000) for each day the obligation is evaded or the duty is not performed, up to a cumulative maximum amount of twenty-five thousand dollars ($25,000), plus an additional twenty-five percent (25%) of the amount or value of any property for which the holder had a duty or obligation to report, pay, or deliver under this part.\n(b) If a holder makes a fraudulent report under this part, the treasurer may assess against the holder a civil penalty of one thousand dollars ($1,000) for each day from the date the fraudulent report was filed until a true and correct report is filed, up to a cumulative maximum of twenty-five thousand dollars ($25,000), plus an additional twenty-five percent (25%) of the amount or value of any property for which the holder had duty to report.","path":["TN Code","Title 66","Chapter 29"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_tn_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:26Z","sha256":"c35da573452163f04e5fd95255a6fcf494bfa14fee7016692ea1f75d853001ae","source_id":"us-tn","stale":false,"prev":"us-tn/tenn.-code-ann.-66-29-173","next":"us-tn/tenn.-code-ann.-66-29-175"},"notice":"GroundRules: Original legal text.
