Code Ann. § 66-33-104","heading":"Recording prohibited","body":"(a) A service provider shall not record or cause to be recorded a service agreement or notice or memorandum of the agreement in this state.\n(b) A service provider who records or causes to be recorded a service agreement or notice or memorandum of the agreement in this state in violation of § 66-33-103 is liable to an affected party for ten thousand dollars ($10,000) in statutory damages.\n(c) Notwithstanding chapter 24 of this title, a register in this state may refuse to accept for recordation a service agreement and is not liable for mistakenly recording an unfair service agreement.\n(d) If a service agreement is recorded in violation of this chapter, then it does not constitute actual or constructive notice to an otherwise bona fide purchaser or creditor.","path":["TN Code","Title 66","Chapter 33"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_tn_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:26Z","sha256":"cec71cc6d121ef53fd4e2d39eeb1fd323b539e65dc5be687bd6a49b82dccbe34","source_id":"us-tn","stale":false,"prev":"us-tn/tenn.-code-ann.-66-33-103","next":"us-tn/tenn.-code-ann.-66-33-105"},"notice":"GroundRules: Original legal text.
