Code Ann. § 70-7-203","heading":"When liability of whitewater professional imposed","body":"Nothing in § 70-7-202 shall be construed to prevent or limit the liability of a whitewater professional, or any other person if the whitewater professional:\n(1) Provided the equipment and knew or should have known that the equipment was faulty, and the equipment was faulty to the extent that it caused the injury;\n(2) Owns, leases, rents, or otherwise is in the lawful possession and control of the land or facilities upon which the participant sustained injuries because of a dangerous latent condition that was known to the whitewater professional, or person and for which warning signs have not been conspicuously posted;\n(3) Commits an act or omission that constitutes gross negligence or willful or wanton disregard for the safety of the participant, and the act or omission caused the injury; or\n(4) Intentionally injures the participant.","path":["TN Code","Title 70","Chapter 7"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_tn_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:26Z","sha256":"729f359c64faa52602f1f789e1ac4cd447e070a26023e6ebb435c11b10751809","source_id":"us-tn","stale":false,"prev":"us-tn/tenn.-code-ann.-70-7-202","next":"us-tn/tenn.-code-ann.-70-7-204"},"notice":"GroundRules: Original legal text.
