Code Ann. § 8-31-108","heading":"Penalty for knowing or intentional violations - Presumptions","body":"(a) A state employee who knowingly or intentionally violates § 8-31-103 , and thereafter willfully fails or refuses to remove or remedy the violation as provided by § 8-31-104 , commits a Class A misdemeanor.\n(b) Upon a violation of § 8-31-103 by a state employee, there is created a rebuttable presumption that a willful failure or refusal to remove or remedy the violation as provided by § 8-31-104 constitutes an actionable basis to institute ouster proceedings under chapter 47 of this title; impeachment proceedings under chapter 46 of this title; or quo warranto proceedings under title 29, chapter 35.","path":["TN Code","Title 8","Chapter 31"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_tn_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:26Z","sha256":"3e5dde569d8571a38da731cfc31551af142d4f3d68b0c6f2673bbc2078ac0f66","source_id":"us-tn","stale":false,"prev":"us-tn/tenn.-code-ann.-8-31-107","next":"us-tn/tenn.-code-ann.-8-31-109"},"notice":"GroundRules: Original legal text.
