Agriculture Code § 122.051","heading":"DEPARTMENT RULES AND PROCEDURES.","body":"(a) The department shall adopt rules and procedures necessary to implement, administer, and enforce this chapter.\n(b) Rules adopted under Subsection (a) must:\n(1) prescribe sampling, inspection, and testing procedures, including standards and procedures for the calibration of laboratory equipment, to ensure that the delta-9 tetrahydrocannabinol concentration of hemp plants cultivated in this state is not more than 0.3 percent on a dry weight basis; and\n(2) provide due process consistent with Chapter 2001, Government Code, including an appeals process, to protect license holders from the consequences of imperfect test results.\nAdded by Acts 2019, 86th Leg., R.S., Ch. 764 (H.B. 1325), Sec. 2, eff.
