Agriculture Code § 132.021","heading":"LICENSE REQUIRED.","body":"(a) A person may not buy or sell eggs in this state for the purpose of resale without first obtaining a license from the department.\n(b) This section does not apply to:\n(1) a hatchery buying eggs exclusively for hatching purposes;\n(2) a hotel, restaurant, or other public eating place where all eggs purchased are served by the establishment;\n(3) a food manufacturer purchasing eggs for use only in the manufacture of food products, except for a person who operates a plant for the purpose of breaking eggs for freezing, drying, or commercial food manufacturing;\n(4) an agent employed and paid a salary by a person licensed under this chapter; or\n(5) a retailer selling eggs to the ultimate consumer of the eggs.\nActs 1981, 67th Leg., p. 1316, ch. 388, Sec. 1, eff.
