Agriculture Code § 71.058","heading":"PENALTIES.","body":"(a) A person commits an offense if the person wilfully or negligently:\n(1) violates a provision of this subchapter; or\n(2) fails or refuses to comply with a notice, order, or rule of the department under this subchapter.\n(b) An offense under Subsection (a) of this section is a Class C misdemeanor.\n(c) Each day that a person maintains premises in a condition not in compliance with this subchapter after receiving notice by registered or certified mail under Section 71.046 of this code is a separate offense.\n(d) Repealed by Acts 2001, 77th Leg., ch. 52, Sec. 1.\nActs 1981, 67th Leg., p. 1159, ch. 388, Sec. 1, eff.
