Agriculture Code § 76.002","heading":"PESTS.","body":"The department shall determine what organisms constitute pests for purposes of this chapter and may include in the list of pests:\n(1) any insect, snail, slug, rodent, bird, nematode, fungus, weed, or other form of terrestrial or aquatic plant or animal life; or\n(2) any virus, bacteria, or other microorganism, other than a virus, bacteria, or other microorganism on or in living man or other living animals.\nActs 1981, 67th Leg., p. 1190, ch. 388, Sec. 1, eff.
