Business \u0026 Commerce Code § 16.059","heading":"TERM AND RENEWAL OF REGISTRATION.","body":"(a) The registration of a mark under this chapter expires on the fifth anniversary of the date of registration.\n(b) The registration of a mark under this chapter may be renewed for an additional five-year term by filing a renewal application in the manner prescribed by the secretary of state and paying a renewal fee not earlier than the 180th day before the date the registration expires.\n(c) An application for renewal under this chapter, whether of a registration made under this chapter, or a registration that took effect under a predecessor statute, must include:\n(1) a verified statement stating that the mark has been and is still in use in this state; and\n(2) a specimen of the mark, as actually used on or in connection with the goods or services.\n(d) A mark for which a registration was in effect on August 31, 2012, continues in effect for the unexpired term of the registration and may be renewed by complying with the requirements for renewal under this section.\nAmended by:\nActs 2011, 82nd Leg., R.S., Ch. 563 (H.B. 3141), Sec. 1, eff.
