Business \u0026 Commerce Code § 304.254","heading":"DETERMINATION OF AMOUNT OF ADMINISTRATIVE PENALTY.","body":"The amount of an administrative penalty imposed under this subchapter must be based on:\n(1) the seriousness of the violation, including the nature, circumstances, extent, and gravity of the violation;\n(2) any history of previous violations;\n(3) the amount necessary to deter a future violation;\n(4) any effort to correct the violation; and\n(5) any other matter that justice may require.\nAdded by Acts 2007, 80th Leg., R.S., Ch. 885 (H.B. 2278), Sec. 2.01, eff.
