Business \u0026 Commerce Code § 52.152","heading":"PRIVATE CAUSE OF ACTION.","body":"(a) This section applies only to a customer who is injured by an invention developer's:\n(1) violation of this chapter;\n(2) false or fraudulent statement, representation, or omission of material fact; or\n(3) failure to make all disclosures required by this chapter.\n(b) A customer to whom this section applies may recover in a civil action against the invention developer:\n(1) the greater of:\n(A) the amount of any actual damages sustained by the customer; or\n(B) $1,000;\n(2) court costs; and\n(3) attorney's fees.\nAmended by:\nActs 2007, 80th Leg., R.S., Ch. 885 (H.B. 2278), Sec. 2.01, eff.
