Civil Practice and Remedies Code § 172.004","heading":"COMMERCIAL AGREEMENT.","body":"An arbitration or conciliation agreement is commercial if it arises out of a relationship of a commercial nature, including:\n(1) a transaction for the supply or exchange of goods or services;\n(2) a distribution agreement;\n(3) a commercial representation or agency;\n(4) an exploitation agreement or concession;\n(5) a joint venture or other related form of industrial or business cooperation;\n(6) the carriage of goods or passengers by air, sea, rail, or road;\n(7) a relationship involving:\n(A) construction;\n(B) insurance;\n(C) licensing;\n(D) factoring;\n(E) leasing;\n(F) consulting;\n(G) engineering;\n(H) financing;\n(I) banking;\n(J) professional services; or\n(K) intellectual or industrial property, including trademarks, patents, copyrights, and software programs; or\n(8) the transfer of data or technology.\nAdded by Acts 1989, 71st Leg., ch. 109, Sec. 1, eff.
