Education Code § 38.202","heading":"ADVISORY COMMITTEE: ESTABLISHMENT AND COMPOSITION.","body":"(a) The commissioner of state health services shall establish an advisory committee to examine and review the administration, on a campus of a school district, an open-enrollment charter school, a private school, or an institution of higher education, of:\n(1) epinephrine delivery systems to a person experiencing an anaphylactic reaction; and\n(2) medication for respiratory distress to a person experiencing respiratory distress.\n(b) The advisory committee shall be composed of members appointed by the commissioner of state health services. In making appointments, the commissioner shall ensure that:\n(1) a majority of the members are physicians with expertise in treating anaphylaxis, including physicians who specialize in the fields of pediatrics, allergies, asthma, and immunology;\n(2) at least one member is a registered nurse employed by a school district, open-enrollment charter school, or private school as a school nurse;\n(3) at least one member is an employee of a general academic teaching institution; and\n(4) at least one member is an employee of a public junior college or a public technical institute.\n(c) A member of the advisory committee serves at the pleasure of the commissioner of state health services.\n(d) A vacancy on the advisory committee is filled by the commissioner of state health services in the same manner as other appointments to the advisory committee.\n(e) In this section, \"general academic teaching institution,\" \"institution of higher education,\" \"public junior college,\" and \"public technical institute\" have the meanings assigned by Section 61.003.\nAdded by Acts 2015, 84th Leg., R.S., Ch. 180 (S.B. 66), Sec. 2, eff.
