Finance Code § 14.251","heading":"ASSESSMENT OF PENALTY; RESTITUTION ORDER.","body":"(a) The commissioner may assess an administrative penalty against a person who knowingly and wilfully violates or causes a violation of this chapter, Chapter 394, or Subtitle B, Title 4, or a rule adopted under this chapter, Chapter 394, or Subtitle B, Title 4.\n(a-1) The commissioner shall assess an administrative penalty against a credit access business who knowingly and wilfully violates or causes a violation of Chapter 393, or a rule adopted under Chapter 393.\n(b) The commissioner may order the following businesses or other persons to pay restitution to an identifiable person:\n(1) a person who violates or causes a violation of this chapter, Chapter 394, or Subtitle B, Title 4, or a rule adopted under this chapter, Chapter 394, or Subtitle B, Title 4;\n(2) a credit access business who violates or causes a violation of Chapter 393 or a rule adopted under Chapter 393; or\n(3) a person who violates or causes a violation of Subchapter B, Chapter 1956, Occupations Code, or a rule adopted under that subchapter.\nActs 1997, 75th Leg., ch. 1008, Sec. 1, eff.
