Finance Code § 371.174","heading":"IDENTIFICATION OF PLEDGOR OR SELLER REQUIRED.","body":"(a) A pawnbroker shall require identification of:\n(1) the pledgor if a transaction is a pawn transaction; or\n(2) the seller if a transaction is a purchase of goods by the pawnbroker.\n(b) Identification is acceptable only if it contains a photograph of the pledgor or seller and is:\n(1) a state driver's license;\n(2) a state identification card;\n(3) a passport;\n(4) a military identification;\n(5) a certificate of identification from the Mexican Consulate, certificado de matricula consular; or\n(6) identification issued by the agency of the United States responsible for citizenship and immigration.\n(c) A pawnbroker shall make the pawnbroker's best effort to determine whether the identification:\n(1) is apparently genuine and unaltered; and\n(2) properly identifies the pledgor or seller.\nActs 1997, 75th Leg., ch. 1008, Sec. 1, eff.
