Government Code § 411.053","heading":"PRESERVATION OF EVIDENCE CONTAINING BIOLOGICAL MATERIAL.","body":"(a) The department:\n(1) shall maintain a storage space for the preservation of evidence containing biological material that is delivered to the department under Article 38.43(f), Code of Criminal Procedure; and\n(2) may maintain a storage space for the preservation of evidence of a sexual assault or other sex offense.\n(b) The department shall adopt rules relating to the delivery, cataloging, and preservation of evidence stored under this section.\nAdded by Acts 2009, 81st Leg., R.S., Ch. 1179 (H.B. 3594), Sec. 2, eff.
