Government Code § 469.152","heading":"WAIVER OR MODIFICATION PROHIBITED.","body":"The commission may not waive or modify a standard or specification if:\n(1) the waiver or modification would significantly impair the acquisition of goods and services by persons with disabilities or substantially reduce the potential for employment of persons with disabilities;\n(2) the commission knows that the waiver or modification would result in a violation of the Americans with Disabilities Act of 1990 (42 U.S.C. Section 12101 et seq.) and its subsequent amendments; or\n(3) the proof presented to the commission under Section 469.151(a)(2) is not adequate.\nAdded by Acts 2003, 78th Leg., ch. 1276, Sec. 9.005(a), eff.
