Government Code § 526.0258","heading":"OPTIONS FOLLOWING DECISION: PAY OR APPEAL.","body":"Not later than the 30th day after the date the hospital receives the order entered by the attorney general under Section 526.0257, the hospital shall:\n(1) pay the amount of the administrative penalty;\n(2) remit the amount of the penalty to the attorney general for deposit in an escrow account and file a petition for judicial review contesting the occurrence of the violation, the amount of the penalty, or both; or\n(3) without paying the amount of the penalty:\n(A) file a petition for judicial review contesting the occurrence of the violation, the amount of the penalty, or both; and\n(B) file with the court a sworn affidavit stating that the hospital is financially unable to pay the amount of the penalty.\nAdded by Acts 2023, 88th Leg., R.S., Ch. 769 (H.B. 4611), Sec. 1.01, eff.
