Government Code § 542.0202","heading":"RECIPIENT CHOICE OF DELIVERY MODEL.","body":"(a) If the commission determines under Section 542.0201(c)(2) that all or a portion of the long-term services and supports previously available under Medicaid waiver programs should be provided through a managed care program delivery model, the commission shall, at the time of the transition, allow each recipient receiving long-term services and supports under a Medicaid waiver program the option of:\n(1) continuing to receive the services and supports under the Medicaid waiver program; or\n(2) receiving the services and supports through the managed care program delivery model the commission selects.\n(b) A recipient who chooses under Subsection (a) to receive long-term services and supports through a managed care program delivery model may not subsequently choose to receive the services and supports under a Medicaid waiver program.\nAdded by Acts 2023, 88th Leg., R.S., Ch. 769 (H.B. 4611), Sec. 1.01, eff.
