Government Code § 544.0104","heading":"EMPLOYMENT OF MEDICAL DIRECTOR.","body":"(a) The office of inspector general shall employ a medical director who:\n(1) is a licensed physician under Subtitle B, Title 3, Occupations Code, and the rules the Texas Medical Board adopts under that subtitle; and\n(2) preferably has significant knowledge of Medicaid.\n(b) The medical director shall ensure that any investigative findings based on medical necessity or the quality of medical care have been reviewed by a qualified expert as described by the Texas Rules of Evidence before the office of inspector general imposes a payment hold or seeks recoupment of an overpayment, damages, or penalties.\nAdded by Acts 2023, 88th Leg., R.S., Ch. 769 (H.B. 4611), Sec. 1.01, eff.
