Government Code § 609.109","heading":"PARTICIPATION OF INDEPENDENT CONTRACTORS.","body":"(a) The plan administrator shall determine whether a person who provides services as an independent contractor to a political subdivision that created the plan may participate in the deferred compensation plan.\n(b) For the purposes of Subchapter A and this subchapter, an independent contractor that is authorized to participate in a deferred compensation plan is treated as an employee of the political subdivision creating the plan.\nAdded by Acts 1993, 73rd Leg., ch. 268, Sec. 1, eff.
