Health and Safety Code § 252.092","heading":"APPOINTMENT BY AGREEMENT.","body":"(a) A person who holds a controlling interest in a facility may request the department to assume the operation of the facility through the appointment of a trustee under this subchapter.\n(b) After receiving the request, the department may enter into an agreement providing for the appointment of a trustee to take charge of the facility under conditions both parties consider appropriate if the department considers the appointment desirable.\n(c) An agreement under this section must:\n(1) specify the terms and conditions of the trustee's appointment and authority; and\n(2) preserve the rights of the residents as granted by law.\n(d) The agreement terminates at the time:\n(1) specified by the parties; or\n(2) either party notifies the other in writing that the party is terminating the appointment agreement.\nAdded by Acts 1997, 75th Leg., ch. 693, Sec. 1, eff.
