Health and Safety Code § 264.028","heading":"EMINENT DOMAIN.","body":"(a) To carry out a power granted by this chapter, the authority may acquire the fee simple title to land, other property, and easements by condemnation under Chapter 21, Property Code.\n(b) The authority is considered to be a municipal corporation for the purposes of Section 21.021(c), Property Code.\n(c) The board shall determine the amount and character of the interest in land, other property, and easements to be acquired under this section.\nActs 1989, 71st Leg., ch. 678, Sec. 1, eff.
