Health and Safety Code § 361.100","heading":"PROHIBITION ON PERMIT FOR CERTAIN HAZARDOUS WASTE MANAGEMENT UNITS.","body":"The commission by rule shall prohibit the issuance of a permit for a new hazardous waste management unit if the landfill:\n(1) is in a floodplain of a perennial stream subject to not less than one percent chance of flooding in any year, delineated on a flood map adopted by the Federal Emergency Management Agency after September 1, 1985, as zone A1-99, V0, or V1-30; and\n(2) receives hazardous waste for a fee.\nActs 1989, 71st Leg., ch. 678, Sec. 1, eff.
