Health and Safety Code § 382.066","heading":"SHIPYARD FACILITIES.","body":"(a) In this section, \"shipyard\" means a shipbuilding or ship repair operation.\n(b) In determining whether to issue, or in conducting a review of, a permit or other authorization issued or adopted under this chapter for a shipyard, the commission:\n(1) may not require and may not consider air dispersion modeling results predicting ambient concentrations of noncriteria pollutants over coastal waters of the state; and\n(2) shall determine compliance with noncriteria ambient air pollutant standards and guidelines according to the land-based off-property concentrations of air contaminants.\n(c) This section does not limit the commission's authority to take an enforcement action in response to a condition that constitutes a nuisance.\nAdded by Acts 2001, 77th Leg., ch. 1166, Sec. 1, eff.
