Health and Safety Code § 401.302","heading":"NUCLEAR REACTOR AND FIXED NUCLEAR FACILITY FEE.","body":"(a) The executive commissioner, in coordination with the commission, by rule may set an annual fee to be collected by the department from the operator of each nuclear reactor or other fixed nuclear facility in the state that uses special nuclear material.\n(b) The amount of fees collected may not exceed the actual expenses that arise from emergency planning and implementation and environmental surveillance activities.\nActs 1989, 71st Leg., ch. 678, Sec. 1, eff.
