Health and Safety Code § 431.051","heading":"DESTRUCTION OF ARTICLE.","body":"(a) A court shall order the destruction of a sampled article or a detained or embargoed article if the court finds that the article is adulterated or misbranded.\n(b) After entry of the court's order, an authorized agent shall supervise the destruction of the article.\n(c) The claimant of the article shall pay the cost of the destruction of the article.\n(d) The court shall tax against the claimant of the article or the claimant's agent all court costs and fees, and storage and other proper expenses.\nActs 1989, 71st Leg., ch. 678, Sec. 1, eff.
