Health and Safety Code § 431.248","heading":"MEMORANDUM OF UNDERSTANDING WITH DEPARTMENT OF AGRICULTURE.","body":"(a) The department and the Department of Agriculture shall execute a memorandum of understanding that:\n(1) requires each agency to disclose to the other agency any positive results of testing conducted by the agency for pesticides in food; and\n(2) specifies how each agency will assist the other in performing its duties regarding pesticides in food.\n(b) The executive commissioner and the Department of Agriculture shall adopt the memorandum of understanding as a rule.\n(c) The department and the Department of Agriculture shall request the federal Food and Drug Administration to join in execution of the memorandum of understanding.\nActs 1989, 71st Leg., ch. 678, Sec. 1, eff.
