Health and Safety Code § 442A.052","heading":"APPLICATION AND SELECTION PROCESSES.","body":"(a) The board shall adopt rules prescribing:\n(1) the form and manner for a pharmacy to apply for participation in the pilot program; and\n(2) evaluation and selection criteria and processes.\n(b) The board shall give priority to a pharmacy applicant that:\n(1) does not collect unused ultimate user prescription drugs under 21 C.F.R. Part 1317 at the time the applicant submits the application; or\n(2) is located in a rural or underserved area the board designates.\n(c) A pharmacy that operates multiple locations must submit an application for each location.\nAdded by Acts 2023, 88th Leg., R.S., Ch. 293 (S.B. 2173), Sec. 1, eff.
